Florida Amendment 2 – Does It Matter?

Mary Jane

On November 4, Florida voters will have the opportunity to vote on an amendment to their state constitution, Amendment 2, to establish a medical marijuana program in that state. The official title reads: Use of Marijuana for Certain Medical Conditions and the official ballot reads: Allows the medical use of marijuana for individuals with debilitating diseases as determined by a licensed Florida physician. Allows caregivers to assist patients’medical use of marijuana. The Department of Health shall register and regulate centers that produce and distribute marijuana for medical purposes and shall issue identification cards to patients and caregivers. Applies only to Florida law. Does not authorize violations of federal law or any non-medical use, possession or production of marijuana. Supporters of Amendment 2 say the measure will help people with debilitating medical conditions. Opponents, on the other hand, argue the amendment is “de facto legalization” of marijuana.
